The requirements and protections of this Policy apply equally regardless of sex, gender, sexual orientation, gender identity or expression, or other protected classes under federal or state law. All requirements and protections are equitably provided to individuals regardless their status as a Complainant, a Respondent, or a witness.
Sexual Misconduct can occur between individuals who know each other, individuals who do not know each other, individuals who have an established relationship, and individuals who have previously engaged in consensual sexual activity.
Sexual Misconduct can be committed by persons of any gender, and it can occur between people of the same or different sex, gender, sexual orientation, or gender identity or expression. Non-Title IX Sexual Misconduct means misconduct that does not fall under the definition of Title IX Sexual Misconduct and is based on sex, gender, sexual orientation, gender identity or expression that is prohibited by other applicable federal non-discrimination laws, Massachusetts law, or WPI policy, including sexual violence e.
Non-Title IX Sexual Misconduct includes sexual misconduct regardless of where it occurred or when it occurred. Off-campus conduct falls under this definition if i the conduct was in connection with a WPI or WPI-recognized program or activity, or ii the conduct may have the effect of creating a hostile environment at WPI or for a member of the WPI community.
Under this policy, and applicable federal and Massachusetts state law, neither WPI nor or any other person may intimidate, threaten, coerce, or discriminate against any individual for the purpose of interfering with any right or privilege secured by Title IX or this policy, or because the individual has made a report or complaint, testified, assisted, or participated or refused to participate in any manner in an investigation, proceeding, or hearing under Title IX or this policy.
